Local Best-fit with tolerances

I have the issue that sometimes, even though I apply the "Use all selected points", I still get some penetration (negative surface deviation). The image shows a dental crown design (green, actual) seated on the abutment (prepared tooth, nominal). How can we totally avoid this?
